Welcome to Gosca! These Terms and Conditions (“Terms”) govern your purchase of products and use of services provided by Gosca (“we,” “us,” or “our”). By placing an order, making a purchase, or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not purchase our products or use our services.
1. Introduction to Gosca
Gosca is a company based in South Africa specializing in the sale of computer and technology hardware, as well as providing related services including repairs, installations, and CCTV solutions.

2. Acceptance of Terms
By purchasing products or engaging our services, you confirm that you are at least 18 years of age or are making a purchase/engaging services under the supervision of a parent or legal guardian. You agree to comply with all applicable laws and regulations regarding your purchase and use of our products and services.
3. Products and Services Offered
Gosca offers the following products and services:
- Computer and Tech Hardware Sales: Sale of a wide range of computer components, peripherals, pre-built systems, networking equipment, software licenses, and other technology-related hardware.
- Repairs: Diagnostics, troubleshooting, and repair services for computers, laptops, mobile devices, and other electronic hardware.
- Installations: Installation services for new hardware, software, networks, and other technology solutions, including setup and configuration.
- CCTV Solutions: Supply, installation, maintenance, and repair of Closed-Circuit Television (CCTV) systems, including cameras, DVR/NVRs, and associated networking.

4. Orders and Quotations (Products)
- All product orders are subject to availability.
- Prices for products are as quoted on our invoices, quotations, or product lists. While we strive for accuracy, errors may occur. We reserve the right to correct any errors and to refuse or cancel orders placed at an incorrect price.
- Quotations are valid for the period stated therein. After this period, prices may be subject to change.
- Placing an order constitutes an offer to purchase the products under these Terms. Acceptance of your order will be confirmed by an order confirmation or invoice.
5. Service Engagements (Repairs, Installations, CCTV, etc.)
- Quotations: For repair, installation, and CCTV services, we will provide a quotation outlining the scope of work, estimated costs, and timelines. This quotation must be accepted by you in writing (e.g., email confirmation) before work commences.
- Diagnostics (for Repairs): A diagnostic fee may apply to determine the nature of a fault, even if no repair is subsequently undertaken or if the device is deemed unrepairable. This fee will be communicated upfront.
- Client Responsibilities: You are responsible for ensuring data backup before any repair service. Gosca is not liable for data loss during repair processes. You must provide necessary access, information, and cooperation for installations and other on-site services.
- Completion: Services will be deemed complete upon Gosca’s notification of completion and, where applicable, your acceptance of the completed work.
6. Pricing and Payment
- All prices for products and services are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable, unless otherwise stated.
- Payment terms will be specified on invoices or quotations (e.g., upfront payment, deposit, payment upon completion, 7-day net).
- We accept [List accepted payment methods, e.g., EFT, credit card, cash].
- Late payments may be subject to interest charges at a rate of [e.g., 2% per month] or as permitted by law, and we reserve the right to suspend further services or withhold products until payment is received.
- Ownership of products only transfers to you once full payment has been received by Gosca.
7. Delivery and Collection (Products)
- Delivery times are estimates and may vary. Gosca is not liable for delays caused by third-party couriers or unforeseen circumstances.
- Risk of loss or damage to products passes to you upon delivery or collection.
- For collections, products must be collected within [e.g., 7 days] of notification of availability. Unclaimed products may incur storage fees or be returned to stock.
8. Warranty
- New Hardware: New computer and tech hardware products are subject to the manufacturer’s warranty. Gosca will assist with warranty claims where possible but is not the warrantor. Warranty terms and duration vary by manufacturer. Physical damage, misuse, or unauthorized modifications will void warranties.
- Repairs: Repair services come with a limited warranty on the specific work performed and parts replaced, typically for a period of [e.g., 30 or 90 days] from the date of repair, against defects in workmanship. This warranty does not cover new faults unrelated to the original repair or faults caused by misuse.
- Installations: Installation services are warranted against defects in workmanship for a period of [e.g., 90 days]. This does not cover damage caused by external factors.
- CCTV Systems: CCTV equipment is subject to manufacturer warranties. Installation of CCTV systems is warranted against defects in workmanship for a period of [e.g., 6 months to 1 year].
- General: Warranties are non-transferable. Our warranty obligations are limited to the repair or replacement of faulty products or re-performance of services, at our discretion.
9. Returns and Refunds (Products)
- Returns of products are subject to our specific return policy, which aligns with the Consumer Protection Act (CPA) of South Africa.
- Defective products may be returned for repair, replacement, or refund, subject to manufacturer warranty terms and inspection by Gosca.
- Non-defective products may only be returned if they are in their original, unopened packaging, undamaged, and within [e.g., 7 days] of purchase, and may be subject to a restocking fee. Software and activated licenses are generally non-returnable.
- Proof of purchase is required for all returns.
10. Limitation of Liability
- While Gosca strives to provide high-quality products and services, we are not liable for:
- Any loss of data during repair or installation processes. It is your responsibility to back up your data.
- Indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or business opportunities.
- Damages resulting from misuse, accidental damage, unauthorized repairs, or modifications by third parties to products sold or services rendered.
- Delays or failures in performance due to events beyond our reasonable control (force majeure).
- Our total liability for any claim arising out of or relating to these Terms, the purchase of products, or the provision of services shall not exceed the amount paid by you for the specific product or service giving rise to the claim.
- Nothing in these Terms shall limit or excludeour liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
11. Indemnification
You agree to indemnify and hold Gosca, its officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal fees, arising out of or in any way connected with your breach of these Terms, your misuse of our products or services, or your violation of any law or the rights of a third party.
12. Data Protection and Privacy (POPIA Compliance)
- Gosca will collect, process, and store your personal information in accordance with the Protection of Personal Information Act (POPIA) of South Africa.
- We will only collect information necessary for the provision of products and services, invoicing, and communication.
- Your personal information will not be shared with unauthorized third parties without your consent, except where required by law.
- By engaging with Gosca, you consent to the collection and processing of your personal information as outlined in our Privacy Policy (if separate) or these Terms.
13. Governing Law and Dispute Resolution
These Termsshall be governed by and construed in accordance with the laws of the Republic of South Africa.
Any dispute arising outof or in connection with these Terms, including any question regarding their existence,validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA) for the time being in force, which rules are deemed to be incorporated by reference into this clause. The seat of the arbitration shall be Bloemfontein, South Africa.
14. Changes to Terms and Conditions
We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our website or by notification to you. Your continued purchase of products or engagement of services after any such changes constitutes your acceptance of the new Terms.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in full force and effect.
16. Entire Agreement
These Terms constitute the entire agreement between you and Gosca regarding the purchase of products and engagement of services, superseding any prior agreements or understandings.
